PGNiG: Information that the ruling of the Svea Court of Appeal in Stockholm of 9 March 2022 on the dismissal of the complaint of Gazprom to set aside the final award of the Arbitral Tribunal dated 30 March 2020 issued in the arbitral proceedings brought by PGNiG against Gazprom regarding the downward revision of the contract price for gas supplied under the Yamal Contract has become final and binding

The management board of Polskie Górnictwo Naftowe i Gazownictwo S.A. (“PGNiG” or the “Company”), in reference to current report No. 15/2022 dated 9 March 2022 concerning the ruling of the Svea Court of Appeal in Stockholm of 9 March 2022 (the “Ruling”) on the dismissal of the complaint of Gazprom PJSC and Gazprom export LLC (hereinafter jointly referred to as “Gazprom”) to set aside the final award of the ad hoc Arbitral Tribunal in Stockholm dated 30 March 2020 (the “Tribunal’s Award”) issued in the arbitral proceedings brought by PGNiG against Gazprom regarding the downward revision of the contract price for gas supplied by Gazprom under the contract for the sale of natural gas to the Republic of Poland of 25 September 1996 (the “Yamal Contract”), hereby reports that on 11th April 2022, the Company was advised by the Svea Court of Appeal in Stockholm that Gazprom has not appealed the Ruling within the prescribed time, which means that the Ruling has become final and binding and that the legal means for Gazprom to challenge the Tribunal’s Award have been exhausted.
